These General Terms and Conditions of Sale are intended to inform any potential buyer of the terms, rights, and obligations of the parties in connection with the sale and delivery of products offered on the website of Nota Gathering B.V..

Any order placed and validated via this website constitutes the customer’s full and unconditional acceptance of these General Terms and Conditions of Sale.

Nota Gathering B.V. reserves the right to amend or update these General Terms and Conditions of Sale at any time. The version applicable to the customer is the one in force at the time the order is placed.

 

Article 1 – Definitions

The following terms and definitions apply in these General Terms and Conditions:

• Right of Withdrawal
  The right of the Customer to withdraw from the Agreement under the conditions set out in these Terms and Conditions.

  Any natural person or legal entity placing an order via the webshop.
• Agreement
  The agreement concluded via the webshop under which You purchase a Product from Nota Gathering B.V.
• Product(s)
  Any item offered, to be delivered, or delivered by Nota Gathering B.V. pursuant to the Agreement.
• Nota Gathering B.V.
  The legal entity Nota Gathering B.V., offering the Products via the webshop.

Article 3 – Agreement

• The Agreement is concluded at the moment You accept the offer (the contents of Your shopping cart) and enter into the corresponding payment obligation by completing the checkout process.
• NOTA Gathering B.V. reserves the right to refuse an order for valid reasons, including but not limited to situations where incorrect payment details have been provided or where the ordered Product appears to be unavailable.
• In such cases, NOTA Gathering B.V. will withdraw the offer and, if payment has already been made, will refund the amount paid without undue delay.

Article 4 – Applicability

• These Terms and Conditions apply to every offer and every Agreement relating to the delivery of Products through the webshop between NOTA Gathering B.V. and You.
• You are given the opportunity to review these Terms and Conditions prior to concluding the Agreement. The most recent version of these Terms and Conditions is always available on the website of NOTA Gathering B.V.
• If, in addition to these Terms and Conditions, specific product or service conditions apply, You may invoke the provision that is most favourable to You in the event of any conflict.

Article 5 – Offer

• All offers are without obligation. The Agreement is definitively concluded by placing an order and completing the payment process (see Article 3).
• Product images are displayed as accurately as possible; however, Products may differ from the images shown. Images on the website are for illustrative purposes only.
• The offer on our website includes a clear and honest description of the Products, enabling You to make an informed purchasing decision.
• Due to the natural origin of tea, variations in colour, taste, aroma, leaf structure, or appearance may occur between batches or harvests. Such variations are inherent to the Product and do not constitute a defect or non-conformity.

Article 6 – Right of Withdrawal

• You have the right to return Your order within 14 days after receipt.
• You can easily register Your return via the link provided on our website.
• Returns are only accepted if the Product was purchased via our own website, is unused, in resalable condition, and returned in its original packaging.
• The right of withdrawal does not apply to Products that are not suitable for return for reasons of health protection or hygiene, where the seal has been broken after delivery. This includes, but is not limited to, opened tea products and other sealed food items.

Article 7 – Costs in Case of Withdrawal

• The costs of returning a Product are at Your own expense (€5.95 for the Netherlands / €6.95 for Belgium/Germany/Luxembourg and €9,95 for the rest of Europe).
• If You have received a damaged or incorrect Product, please contact us at support@notagathering.com. In such cases, the return costs will be reimbursed by NOTA Gathering B.V.
• Refunds, minus the return costs where applicable, will be processed by NOTA Gathering B.V. within 14 days after receipt of the returned Product.
• Damaged return shipments will not be refunded unless You can demonstrate that You are not responsible for the damage incurred during the return shipment.
• We recommend taking a photograph of the package prior to shipment, with the return label clearly visible, so that You can demonstrate the condition in which the Product was returned.

Article 8 – Prices and Discounts

• You pay the price displayed in the webshop at the time You place Your order.
• Prices of Products, shipping costs, and any free-shipping thresholds may change on a daily basis.
• You are not entitled to a refund of any price difference if the price of a Product is reduced after You have placed Your order or if You have missed a promotional or discount period.

Article 9 – Quality and Complaints

• NOTA Gathering B.V. guarantees the quality of its Products. You are therefore always entitled to receive a Product that conforms to the description provided at the time of purchase.
• If You have a complaint regarding a Product or our service, please contact us as soon as possible at support@notagathering.com and clearly explain the reason for Your complaint. Where possible, please include photographs or other supporting evidence.
• You will receive a substantive response to Your complaint within 7 days of receipt.

Article 10 – Delivery

• NOTA Gathering B.V. delivers Products exclusively within the Netherlands and Belgium. For up-to-date information regarding delivery conditions, please refer to our website.
• The risk of loss or damage to the Products remains with NOTA Gathering B.V. until the moment of delivery to You.
• If Your order is delivered to a parcel pickup point and is not collected, it will be returned to us. In such cases, a return fee of €5.95 will be charged. This amount will be deducted from the refund of the purchase price.

Article 11 – Payment

• Payment for Your order is made directly in the webshop using the available payment methods.
• The order is only completed once the payment has been successfully processed.

Article 12 – Force Majeure

NOTA Gathering B.V. shall not be liable for any failure or delay in the performance of its obligations under the Agreement if such failure or delay is caused by circumstances beyond its reasonable control. Such circumstances include, but are not limited to, natural disasters, extreme weather conditions, crop failures, supplier shortages, transport disruptions, strikes, government measures, or failures of logistics partners.

If a force majeure situation continues for an extended period, NOTA Gathering B.V. will inform You as soon as reasonably possible.

Article 13 – Miscellaneous

• Dutch law applies to the Agreement and these Terms and Conditions.
• If You reside in another member state of the European Union and mandatory consumer protection laws of that country grant You more extensive rights, You may also rely on those rights.
• If any provision of the Agreement or these Terms and Conditions is declared invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
• In order to process and deliver Your order, NOTA Gathering B.V. processes Your personal data with due care, as described in our Privacy Policy.
• NOTA Gathering B.V. reserves the right to amend or supplement these Terms and Conditions at any time.
• The version of the Terms and Conditions that was available on the order page at the time of payment shall apply to Your Agreement.
